1. Who We Are and Acceptance of These Terms
Ometell is a personal online service operated by Realbitt, an individual operating under the name “Ometell,” from Palestine. Ometell is a project and trading name and is not a separate incorporated legal entity. References to “Ometell,” “we,” “us,” or “our” in these Terms refer to Realbitt. These Terms of Use (“Terms”) govern access to Ometell.com and related websites, applications, features, content, and services (collectively, the “Service”).
By accessing or using the Service, creating an account, or purchasing Coins, you confirm that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If mandatory law gives you rights that cannot be waived, these Terms do not limit those rights.
2. Adults Only — Minimum Age 18
THE SERVICE IS STRICTLY FOR PERSONS WHO ARE AT LEAST 18 YEARS OLD. No person under 18 may access, browse, register for, or use the Service, even with permission from a parent or guardian.
By using the Service, you represent and warrant that you are at least 18 and legally able to enter into a binding agreement. We may request reasonable age-assurance information, restrict access while age is being checked, and suspend or terminate any account we reasonably believe belongs to or is being used by a person under 18. If you encounter or suspect a minor, end the interaction immediately and report it through the in-service reporting tool or to ometellapp@gmail.com.
We may retain limited records needed to document and enforce an age-related restriction, protect users, comply with law, and prevent repeat access, as described in the Privacy Policy.
3. What Ometell Provides
Ometell is a creative social platform that may match adults for random one-to-one video and text conversations and may offer shared drawing, games, talent-sharing features, Coins, virtual gifts, and other interactive tools. Features may differ by device, country, account status, or time.
Random matching involves strangers. We do not guarantee any user’s identity, statements, background, intentions, location, age, conduct, compatibility, or safety. A verified login, profile, or payment does not mean that Ometell endorses or has background-checked that person. Use good judgment, do not disclose sensitive information, and leave and report any unsafe interaction. Ometell is not an emergency service; contact local emergency services if anyone is in immediate danger.
4. Accounts and Access
Some features require an account or sign-in through a third-party identity provider such as Google. You must provide accurate information, keep access credentials and devices secure, and promptly notify ometellapp@gmail.com of suspected unauthorized use. You are responsible for activity conducted through your account to the extent permitted by law.
You may not sell, license, share, or transfer an account; create accounts using false or stolen information; evade a suspension; or use another person’s account without authorization. We may limit duplicate accounts, simultaneous sessions, automated access, or other activity reasonably necessary to protect the Service.
5. Safety Rules and Prohibited Conduct
You must comply with all applicable laws and these Terms. You must not use the Service to create, display, transmit, request, promote, facilitate, or engage in:
- any access or participation by a person under 18, or content that depicts, sexualizes, exploits, grooms, endangers, or seeks to contact a minor;
- child sexual abuse material, sexual exploitation, non-consensual intimate imagery, sextortion, trafficking, or any sexual content involving or appearing to involve a minor;
- nudity, explicit sexual acts, sexual solicitation, pornography, or other sexually explicit conduct where prohibited by our Community Guidelines or applicable law;
- harassment, stalking, threats, blackmail, humiliation, bullying, hate speech, violent extremism, terrorism, incitement, or credible threats of violence or self-harm;
- fraud, impersonation, deceptive fundraising, phishing, scams, money laundering, illegal gambling, or the sale or promotion of illegal or regulated goods or services;
- sharing another person’s private or identifying information without lawful authority, including doxxing;
- recording, photographing, screenshotting, publishing, facially recognizing, or otherwise exploiting another user or a private communication without all consent required by law;
- infringing copyright, trademark, privacy, publicity, confidentiality, or other rights;
- malware, harmful code, denial-of-service activity, scraping, bots, spam, unauthorized advertising, or attempts to probe, bypass, reverse engineer, or interfere with security, rate limits, moderation, matching, payments, or the operation of the Service; or
- encouraging, helping, or attempting any prohibited conduct.
We may publish and update Community Guidelines that form part of these Terms. Where the Guidelines and these Terms differ, the stricter safety requirement applies unless mandatory law requires otherwise.
6. Your Content and Communications
"User Content" means content you submit, display, transmit, or make available through the Service, including profile information, text, drawings, game activity, reports, and live audio or video. As between you and Ometell, you retain ownership of your User Content.
You grant Ometell a worldwide, non-exclusive, royalty-free, sublicensable license to host, cache, reproduce, adapt for technical formatting, transmit, display, review, and otherwise process User Content only as reasonably necessary to operate, secure, moderate, improve, and provide the Service; comply with law; enforce these Terms; and investigate reports. The license ends when the relevant content is deleted from our systems, except for lawful retention, backups, evidence, and content already shared with or captured by others.
You represent that you have all rights and permissions necessary for your User Content and that it complies with these Terms. Do not share passwords, financial credentials, government identifiers, precise home addresses, medical information, or other sensitive information with strangers.
Although Ometell may not routinely record live calls, another user may use external tools to record or capture an interaction. We cannot guarantee that another user will comply with these Terms. You are responsible for what you choose to show or say.
7. Moderation, Reporting, and Enforcement
We may use user reports, technical signals, automated tools, and human review to detect suspected violations. To the extent permitted by law, we may warn users; restrict matching, messaging, purchases, visibility, or features; remove or preserve content; freeze a balance connected to suspected fraud; suspend or terminate access; and refer matters to payment providers, trusted safety organizations, or competent authorities.
Moderation systems can make mistakes and we do not promise that all harmful or unlawful conduct will be detected or prevented. Our right to moderate does not create a general obligation to monitor every private or live interaction. Nothing in these Terms limits any duty imposed on us by applicable law.
Use the in-service report function to report a user or conduct. Notices alleging illegal content should be sent through ometellapp@gmail.com and should identify the content or user, explain why it is illegal, provide available supporting information, and include the notifier’s contact details and good-faith statement. Where required by law, we will provide reasons for a restriction and access to an internal complaint or appeal process at ometellapp@gmail.com. Knowingly submitting false or abusive reports is prohibited.
8. Coins, Virtual Gifts, and Account Balance
8.1 Limited digital license
"Coins" are a limited, personal, revocable, non-exclusive license to access specified digital features or virtual gifts within the Service. Coins and any promotional or account balance are not legal tender, electronic money, a deposit, a bank account, a security, cryptocurrency, or property. They have no cash value outside the Service and cannot be sold, transferred, exchanged, or redeemed for cash except through a separate creator or earnings program expressly offered by Ometell and subject to its additional terms.
8.2 Prices, payment, and delivery
Prices, package quantities, exchange rates, taxes, fees, and available payment methods are shown at checkout and may change prospectively. You authorize Ometell and its payment processor to charge the selected amount and represent that you are authorized to use the payment method. Coins are normally delivered after payment confirmation. Cryptocurrency network delays, exchange-rate movement, underpayments, overpayments, or third-party fees may affect confirmation and any resulting account credit as disclosed at checkout.
8.3 No refunds for Coins
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL COIN PURCHASES ARE FINAL AND NON-REFUNDABLE ONCE THE COINS OR RELATED DIGITAL CREDIT HAVE BEEN ADDED TO YOUR ACCOUNT OR USED. We do not refund unused Coins, used Coins, virtual gifts, buyer’s remorse, accidental gifts, dissatisfaction with another user, loss of access caused by your breach, or changes in personal circumstances.
This no-refund rule does not exclude refunds or remedies that mandatory law requires. We may also correct a verified duplicate charge, failed delivery, unauthorized transaction, or material technical error. Contact ometellapp@gmail.com promptly with the transaction identifier. A refund, when legally required or expressly approved, may result in removal of the corresponding Coins, gifts, benefits, or balance.
If you are a consumer with a statutory withdrawal right for digital content or a digital service, checkout will ask you to expressly request immediate supply and acknowledge that, once supply begins or the digital content is made available, you lose the withdrawal right to the extent permitted by applicable law. Ometell must record that express request and acknowledgment and provide the legally required confirmation. If this consent flow is not presented where required, your mandatory withdrawal rights may remain unaffected.
8.4 Gifts, reversals, and misuse
Sending a virtual gift is an instruction to consume the stated number of Coins and is generally irreversible. A recipient does not acquire ownership of the purchase price or a right to a fixed payout merely by receiving a gift. Any eligibility to earn, conversion rate, minimum payout, identity or tax verification, reserve, chargeback allocation, or forfeiture is governed by separately displayed earnings terms.
We may reverse or withhold Coins, gifts, balance, or related benefits obtained through fraud, chargeback, refund, payment reversal, technical error, prohibited transfer, or abuse. We will not intentionally remove valid paid Coins without a lawful basis. Except where prohibited by law, unresolved chargebacks or payment fraud may result in account restriction or collection of amounts owed.
9. Third-Party Services
The Service may depend on third parties for login, payment, hosting, content delivery, communications, advertising, or other functions. Their own terms and privacy practices may apply. Ometell is not responsible for an independent third party’s services, content, outage, or conduct, except to the extent responsibility cannot legally be excluded. Links do not imply endorsement.
10. Ometell Intellectual Property
The Service, excluding User Content, and all related software, design, graphics, trademarks, logos, databases, and content are owned by or licensed to Ometell and protected by law. Subject to these Terms, we grant you a limited, revocable, non-transferable, non-sublicensable license to use the Service for personal, non-commercial purposes. No other right is granted.
You may not copy, sell, rent, distribute, publicly display, modify, create derivative works from, reverse engineer, or exploit the Service except as expressly permitted by law or written permission. Feedback may be used by Ometell without restriction or compensation, provided it does not identify you publicly without permission.
11. Copyright and Rights Complaints
To report claimed copyright or other rights infringement, contact ometellapp@gmail.com with: identification of the protected work or right; identification and location of the material; your contact details; a good-faith statement; a statement of accuracy and authority; and any signature required by applicable law. We may forward a complaint to the affected user and may process counter-notices where applicable.
12. Service Changes, Availability, and Beta Features
We may maintain, update, add, limit, or discontinue features for legitimate operational, security, legal, or business reasons. We do not guarantee uninterrupted, secure, or error-free availability or any particular match. Material changes affecting paid digital content will be handled consistently with mandatory consumer law. Beta features may be incomplete and may change or end.
13. Suspension, Termination, and Account Closure
You may stop using the Service at any time and may request account deletion as explained in the Privacy Policy. We may restrict, suspend, or terminate access when reasonably necessary for suspected violations, safety, fraud prevention, legal compliance, non-payment, technical protection, or discontinuation of the Service. Where required, we will give notice, reasons, and an opportunity to appeal unless doing so would be unlawful or undermine safety or an investigation.
After termination, your license to use the Service ends. Provisions that by their nature should survive will survive, including ownership, payment obligations, disclaimers, liability limits, dispute terms, and lawful evidence retention. Treatment of unused paid Coins upon a permanent Service-wide discontinuation will comply with applicable law; unused Coins may otherwise be lost upon termination for a serious or repeated breach to the extent permitted by law.
14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." OMETELL DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING. We do not warrant users’ identity or conduct; that interactions will be safe, appropriate, accurate, or successful; or that harmful content will always be detected. Some jurisdictions do not allow certain disclaimers, so they apply only to the extent lawful.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMETELL AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY, ARISING FROM THE SERVICE OR INTERACTIONS WITH USERS, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO OMETELL DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD 100 (OR THE LOCAL-CURRENCY EQUIVALENT).
Nothing excludes or limits liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence where non-excludable, death or personal injury caused by negligence where applicable, or mandatory consumer and data-protection rights.
16. Indemnity
To the extent permitted by law, if you use the Service on behalf of a business or in a non-consumer capacity, you will indemnify and hold Ometell harmless from third-party claims, losses, and reasonable costs arising from your unlawful use, User Content, or material breach of these Terms. This clause does not apply to consumers where prohibited and does not require indemnification for Ometell’s own wrongdoing.
17. Governing Law and Disputes
These Terms are governed by the laws of Palestine, without regard to conflict-of-law rules. Subject to mandatory law, the courts of Palestine have jurisdiction. If you are a consumer, this choice does not deprive you of mandatory protections of your country of residence or your right to bring proceedings in a court available under applicable consumer law.
Before filing a claim, please send a written description and requested resolution to ometellapp@gmail.com. This informal step does not shorten any limitation period or prevent urgent relief. Nothing in these Terms requires arbitration unless a separately valid arbitration agreement is presented and accepted where lawful.
18. Changes to These Terms
We may update these Terms for legal, security, operational, or feature changes. We will post the updated version and effective date and provide additional notice when required. Material changes will apply prospectively after the notice period required by law. Continuing to use the Service after the effective date means acceptance where legally permitted; otherwise, you must stop using the Service.
19. General
If a provision is unenforceable, it will be modified only as much as necessary and the remainder stays effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, reorganization, or transfer of the Service, subject to applicable law. These Terms, the Privacy Policy, Community Guidelines, checkout disclosures, and any feature-specific terms form the agreement between you and Ometell regarding the Service.
